Statutory definition

Section 101 of the Migration Act 1958 (Cth) provides:

An applicant for a points-tested visa satisfies the points test if:

(a) the number of points that the Minister has assessed the applicant as having under section 93 is at least the relevant pass mark; and

(b) the applicant has been invited, in accordance with the regulations, to make the application.

Explanation

The points test is the selection mechanism used for skilled migration visas in Australia. It assigns a numerical score to applicants based on defined attributes — such as age, English language ability, skilled work experience, and educational qualifications — and compares that score against a minimum threshold (the pass mark) to determine eligibility.

The points test has two components, both of which must be satisfied:

  1. Score at or above the pass mark: The applicant's assessed points score (calculated under r 2.72 of the Migration Regulations) must be at least equal to the pass mark set by the Minister. The minimum pass mark is currently 65 points.
  2. Valid invitation: The applicant must have been invited to apply through SkillSelect in accordance with the regulations.
