1.15A Spouse or de facto partner — sponsorship requirements

(1) For the purposes of these Regulations, a person is the sponsoring spouse or de facto partner of a visa applicant if:

(a) the person is an Australian citizen, Australian permanent resident, or eligible New Zealand citizen; and

(b) the person is:

(i) the spouse of the applicant; or

(ii) the de facto partner of the applicant (within the meaning of regulation 1.05A).

(2) A person may not be approved as a sponsor under this regulation if:

(a) the person has previously sponsored 2 or more spouses or de facto partners for partner visas; or

(b) the person has previously sponsored a spouse or de facto partner for a partner visa within the 5 years preceding the application.
