2.12C Unauthorised maritime arrivals
(1) This regulation applies to a person who is an unauthorised maritime arrival (within the meaning of the Migration Act 1958) and who is in Australia.
(2) Subject to this regulation, a person to whom this regulation applies cannot make a valid application for a visa while in Australia.
(3) Subsection (2) does not apply if the Minister has, under subsection 46A(2) of the Act, determined that subsection 46A(1) does not apply to the person.
