4.31 Merits review — prescribed authorities

(1) For the purposes of the Act, the prescribed review authority for decisions of a kind listed in Schedule 5 is the authority set out in Schedule 5 against that kind of decision.

(2) The Administrative Review Tribunal is the prescribed review authority for the majority of reviewable migration decisions under Part 5 and Part 7 of the Act.

(3) The Administrative Review Tribunal (in its immigration assessment function) is the review authority for fast-track reviewable decisions under Part 7AA of the Act.
