Text of provision
(1) Subject to subsection (2), the calculation of days under paragraph 28(2)(a) of the Act in respect of a permanent resident does not include any day after
(a) a report is prepared under subsection 44(1) of the Act on the ground that the permanent resident has failed to comply with the residency obligation; or
(b) a decision is made outside of Canada that the permanent resident has failed to comply with the residency obligation.
(2) If the permanent resident is subsequently determined to have complied with the residency obligation, subsection (1) does not apply.

Regulation 62 assigns maximum points (25) for education in the FSW grid based on the level of credential obtained and whether the credential was obtained in Canada or abroad. A Canadian PhD or a foreign PhD equivalent scores the maximum. Secondary school only scores the minimum applicable.
Foreign credentials must be assessed by a designated credential evaluation organisation (e.g., WES, ICAS) to establish their Canadian educational equivalency.
Practical effect
Educational credential assessment (ECA) by a designated organisation is mandatory for applicants who obtained their degrees outside Canada. The ECA converts the foreign degree to its Canadian equivalent, which then determines the points scored. An ECA showing a foreign degree is equivalent to a Canadian bachelor's degree scores the same points as a Canadian bachelor's. The ECA organisation does not assess the credential against Canadian professional licensing standards — that is a separate process managed by regulatory bodies.
