Regulation 72.8 — Express Entry — eligible candidates

Subject to subsections 25.1(3) to (5) and for the purposes of this Part, to be considered a family member of an applicant, a person must be a family member of the applicant both at the time the application under Division 6 of Part 5 is made and at the time of the determination of the application.

Regulation 72.8 provides that a foreign national may create an Express Entry profile if they meet the minimum requirements for at least one of the three Express Entry programs: the Federal Skilled Worker class, the Federal Skilled Trades class, or the Canadian Experience Class. They must also meet the minimum language requirements and, for FSW applicants, the minimum points threshold under r 57.
A profile in the Express Entry pool assigns the applicant a Comprehensive Ranking System (CRS) score based on human capital factors, skill transferability, and additional factors.
Practical effect
Express Entry is the intake management system — not a visa class itself. Eligibility for Express Entry is determined by eligibility for one of the three underlying programs. Candidates who are eligible for multiple programs are entered in a single pool. The CRS score determines priority for Invitations to Apply (ITAs). Candidates who do not receive an ITA within 12 months can refresh their profile; unused profiles expire.
