Clause 186.211 — Employer Nomination Scheme — primary criteria
The applicant must, at the time of application or decision (as applicable):
(a) be nominated by an Australian employer who is an accredited sponsor or who has an approved nomination for the applicant in the relevant stream;
(b) satisfy the requirements of the applicable stream:
(i) Direct Entry stream: have the relevant skills assessment and at least 3 years recent work experience; or
(ii) Temporary Residence Transition (TRT) stream: have held a Subclass 482 (or predecessor 457) visa for at least 2 years with the same nominating employer in the same occupation; or
(iii) Labour Agreement stream: meet the requirements of the applicable labour agreement;
(c) have proficient English (or better) (IELTS 7.0 per band or equivalent), unless exempt;
(d) be under 45 years of age, unless exempt;
(e) satisfy health (PIC 4005 or 4007) and character (PIC 4001) criteria.
