Clause 820.211 — Partner (Temporary) — primary criteria (time of decision)

The applicant must, at the time of decision:

(a) be sponsored by a person who meets the requirements of r 1.15A;

(b) be the spouse or de facto partner (within the meaning of regulation 1.05A) of the sponsor; and the relationship must be genuine;

(c) be in Australia at the time of application (onshore application);

(d) satisfy health (PIC 4005) and character (PIC 4001) criteria;

(e) not have a present substantive bar under regulation 2.12 (if applicable).
