2.40A Cancellation — notice requirements

(1) Before cancelling a visa under section 116 of the Act, an officer must give the visa holder written notice:

(a) stating the ground on which the officer is considering cancellation; and

(b) inviting the holder to show cause, in writing, within a specified period (being not less than 3 days), why the visa should not be cancelled.

(2) The officer must consider any response received within the specified period before making a decision.

(3) This regulation does not apply if the officer is satisfied that the holder is not in immigration clearance and cannot be located for the purposes of giving notice.
