Schedule 4, Public Interest Criterion 4020 — Misrepresentation

(1) There is no evidence before the Minister that the applicant (or a member of the family unit of the applicant, if that person is an applicant) has, in connection with the application or a previous visa application:

(a) made a false or misleading statement; or

(b) presented a bogus document (within the meaning of the Act).

(2) For the purposes of this criterion, the reference period during which the use of a bogus document or false statement triggers the bar is:

(a) 3 years from the date of the decision on the affected application; or

(b) 10 years, if the applicant was aged 18 or over at the time of the bogus document use or false statement and the misrepresentation was intentional.
